Käyttöehdot

Nämä käyttöehdot koskevat Awuu-mobiilisovelluksen ja siihen liittyvien verkkosivujen (yhdessä "palvelu") käyttöä.

1. Palvelun kuvaus

Awuu on sovellus, joka välittää koirien ja niiden omistajien välisiä tapaamisia ja tapahtumia sekä näyttää käyttäjien ilmoittamia lähialueen vaaroja. Palvelu tarjotaan sellaisenaan. Palvelu on käyttäjälle maksuton ja rahoitetaan sovelluksessa näytettävillä mainoksilla. Emme takaa palvelun keskeytyksetöntä saatavuutta emmekä sen virheettömyyttä, ja voimme muuttaa palvelua tai lopettaa sen tarjoamisen.

2. Ikäraja ja käyttäjätili

Palvelu on tarkoitettu 16 vuotta täyttäneille. Olet vastuussa omista kirjautumistiedoistasi ja tililläsi tapahtuvasta toiminnasta. Voit poistaa tilisi milloin tahansa sovelluksen Poista tili -toiminnolla (Profiili → Tili); katso tietojen poistaminen.

3. Ehtojen hyväksyminen

Hyväksyt nämä ehdot rekisteröitymällä palveluun. Jos et hyväksy ehtoja, älä käytä palvelua.

4. Tapaamiset ja vastuunrajoitus

Awuu toimii ainoastaan teknisenä välitysalustana käyttäjien välisille tapaamisille ja tapahtumille eikä toimi tapahtumien järjestäjänä. Awuu ei tarkista eikä todenna käyttäjien antamia tietoja, kuten profiileja tai koirien tietoja. Käyttäjät vastaavat itse koiriensa terveydestä, rokotuksista, turvallisuudesta ja soveltuvuudesta tapaamisiin.

Awuu ei vastaa koirien käyttäytymisestä, terveydestä tai turvallisuudesta eikä mistään tapaamisissa tai tapahtumissa käyttäjille, koirille tai kolmansille osapuolille aiheutuvista vahingoista, ellei pakottavasta lainsäädännöstä muuta johdu. Myöskään tapahtuman palvelussa luonut käyttäjä ei vastaa muiden osallistujien tai heidän koiriensa vahingoista. Koirat ovat aina omistajiensa tai haltijoidensa vastuulla, ja tapaamisiin osallistutaan omalla vastuulla.

5. Käyttösäännöt

Palvelussa edellytetään asiallista käytöstä. Kiellettyä on erityisesti:

häirintä, uhkailu ja epäasiallinen käytös muita käyttäjiä kohtaan
esiintyminen toisena henkilönä tai toisen koiran esittäminen omana
lainvastaisen, loukkaavan, harhaanjohtavan tai muuten sopimattoman sisällön julkaiseminen
palvelun käyttö muuhun kuin sen tarkoitukseen (esim. roskaposti tai kaupallinen mainonta ilman lupaa)
ilmoitus- tai estotoiminnon käyttö perusteettomasti tai kiusantekona sekä eston kiertäminen esimerkiksi toisella tilillä.

6. Ilmoittaminen, estäminen ja moderointi

Ilmoittaminen. Voit ilmoittaa ylläpidolle sääntöjen vastaisesta viestistä (paina viestiä pitkään), käyttäjästä (keskustelun valikko), profiilista (profiilin valikko) tai vaarailmoituksesta (ilmoituksen tiedot). Ilmoitus on luottamuksellinen: ilmoitettu käyttäjä ei saa tietää, kuka ilmoituksen teki. Ilmoitettu sisältö ja tarvittaessa sen lähiviestit toimitetaan ylläpidolle ilman päästä päähän -salausta, ja tekstisisältö voidaan esiseuloa automaattisesti ennen ylläpidon käsittelyä. Ilmoitusten käsittely on kuvattu tietosuojaselosteessa.

Estäminen. Voit estää toisen käyttäjän keskustelun, profiilin tai ryhmäkeskustelun osallistujalistan valikosta. Eston jälkeen ette näe toisianne koirakavereissa, kartalla ettekä tapahtumissa, estetty ei voi lähettää sinulle viestejä eikä aloittaa uutta keskustelua, ja hänen viestinsä yhteisissä ryhmäkeskusteluissa piilotetaan sinulta. Estetylle ei ilmoiteta estosta. Voit purkaa eston milloin tahansa (Tili → Estetyt käyttäjät), jolloin näkyvyys ja keskusteluhistoria palautuvat. Esto ei poista kumpaakaan osapuolta tapahtumista, joihin molemmat osallistuvat.

Moderointi ja seuraamukset. Ylläpito voi poistaa sääntöjen vastaista sisältöä, antaa varoituksen, rajoittaa viestintää määräajaksi, poistaa käyttäjän tapahtumasta tai sulkea tilin, jos näitä ehtoja rikotaan. Tapahtuman järjestäjä voi lisäksi poistaa osallistujan järjestämästään tapahtumasta. Toistuvat rikkomukset johtavat tilin sulkemiseen.

7. Vaarailmoitukset

Sisältö. Voit ilmoittaa kartalle lähialueen vaaroista: irtokoirasta, vaarallisesta paikasta, myrkkysyötistä tai muusta vaarasta. Ilmoitus sisältää vaaran tyypin, sijainnin, vaara-asteen, kuvauksen ja valinnaisen kuvan. Muut käyttäjät voivat vahvistaa ilmoituksen, lisätä irtokoirailmoitukseen havaintoja ja seurata sitä. Ilmoitukset näytetään muille ilman ilmoittajan tietoja.

Todenperäisyys ja vastuu. Ilmoita vain vaaroista, jotka olet itse havainnut tai joista sinulla on perusteltu syy uskoa niiden olevan todellisia. Vaarailmoitukset ja havainnot ovat käyttäjien omia ilmoituksia. Awuu ei todenna niitä eikä vastaa niiden oikeellisuudesta, ajantasaisuudesta tai kattavuudesta; ilmoituksen puuttuminen ei tarkoita, että alue olisi turvallinen. Awuu ei vastaa vahingoista, jotka aiheutuvat ilmoituksiin luottamisesta tai niiden puuttumisesta, ellei pakottavasta lainsäädännöstä muuta johdu. Hätätilanteessa ota yhteyttä viranomaisiin.

Rajat. Voit tehdä enintään 3 vaarailmoitusta 24 tunnissa ja lisätä samaan ilmoitukseen enintään yhden havainnon tunnissa. Ilmoitus näkyy kartalla 24 tuntia (myrkkysyötti 7 päivää); uusi havainto pidentää irtokoirailmoituksen näkyvyyttä enintään 7 päivään ilmoituksen luomisesta.

Kuvat ja oma koira. Vaarailmoitukseen tai havaintoon liittämäsi kuva on julkinen ja kaikkien käyttäjien nähtävissä. Jos ilmoitat oman koirasi kadonneeksi, ilmoitukseen liitetään koirasi rotu ja profiilikuva; profiilisi nimi ja kuva näytetään ilmoituksessa vain, jos annat siihen luvan ilmoitusta tehdessäsi.

Väärinkäyttö. Perättömät, harhaanjohtavat tai kiusantekona tehdyt vaarailmoitukset ja havainnot sekä ilmoitusten käyttö toisen käyttäjän tai koiran mustamaalaamiseen ovat kiellettyjä. Toistuva ilmoittelu samalle alueelle merkitään automaattisesti ylläpidon tarkistettavaksi. Väärinkäytöstä voi seurata ilmoitusten poistaminen, varoitus, ilmoitusoikeuden rajoittaminen tai tilin sulkeminen kohdan 6 mukaisesti.

8. Käyttäjän sisältö ja lisenssi

Omistat itse palveluun lisäämäsi sisällön (esim. kuvat, tekstit, tapahtumat ja vaarailmoitukset). Annat Awuulle rajatun oikeuden näyttää ja välittää sisältöäsi palvelussa siinä laajuudessa kuin palvelun tarjoaminen edellyttää. Oikeus päättyy, kun poistat sisällön tai tilisi.

Julkaisu Awuun sosiaalisen median tileillä. Jos annat tapahtuman kuvagalleriassa erikseen luvan, Awuu saa julkaista lataamasi tapahtumakuvan Awuun omilla sosiaalisen median tileillä (esim. Instagram) ja mainita profiiliisi tallentamasi Instagram-käyttäjänimen kuvan yhteydessä. Lupa on vapaaehtoinen, eikä sen antaminen ole edellytys kuvan lataamiselle galleriaan. Voit perua luvan milloin tahansa ottamalla yhteyttä osoitteeseen info@awuu.app, jolloin kuva poistetaan Awuun tileiltä. Tilin poisto ei poista jo julkaistuja kuvia automaattisesti; pyydä niiden poistoa samasta osoitteesta.

9. Tietosuoja

Henkilötietojen käsittely on kuvattu tietosuojaselosteessa.

10. Muutokset ehtoihin

Voimme päivittää näitä ehtoja. Olennaisista muutoksista ilmoitetaan palvelussa. Muutokset merkitään uudella versionumerolla ja päiväyksellä sivun alkuun.

11. Sovellettava laki ja erimielisyydet

Näihin ehtoihin sovelletaan Suomen lakia. Mahdolliset erimielisyydet pyritään ensisijaisesti ratkaisemaan neuvottelemalla. Jos erimielisyyttä ei saada ratkaisuksi, se ratkaistaan Suomessa toimivassa toimivaltaisessa käräjäoikeudessa.

Terms of Service

These terms govern the use of the Awuu mobile app and its related websites (together, the "service").

1. Description of the service

Awuu is an app that facilitates meetups and events between dogs and their owners and shows dangers in the local area reported by users. The service is provided as is. The service is free of charge for users and is funded by ads shown in the app. We do not guarantee uninterrupted availability or freedom from errors, and we may change the service or discontinue it.

2. Age limit and user account

The service is intended for users aged 16 and over. You are responsible for your own login credentials and for the activity on your account. You can delete your account at any time with the Delete account function in the app (Profile → Account); see data deletion.

3. Accepting these terms

You accept these terms by registering for the service. If you do not accept the terms, do not use the service.

4. Meetups and limitation of liability

Awuu acts solely as a technical platform facilitating meetups and events between users and does not act as an organiser of the events. Awuu does not check or verify the information provided by users, such as profiles or dogs' details. Users are themselves responsible for their dogs' health, vaccinations, safety, and suitability for meetups.

Awuu is not responsible for the behaviour, health, or safety of the dogs, nor for any damage caused at meetups or events to users, dogs, or third parties, unless otherwise required by mandatory law. Likewise, the user who created an event in the service is not responsible for damage involving other participants or their dogs. Dogs are always the responsibility of their owners or handlers, and participation in meetups is at your own risk.

5. Rules of conduct

Appropriate behaviour is required in the service. In particular, the following are prohibited:

harassment, threats, and inappropriate behaviour towards other users
impersonating another person or presenting someone else's dog as your own
publishing unlawful, offensive, misleading, or otherwise inappropriate content
using the service for purposes other than its intended purpose (e.g. spam or commercial advertising without permission)
misusing the report or block features without grounds or to harass, and circumventing a block, for example with another account.

6. Reporting, blocking, and moderation

Reporting. You can report a message (long-press the message), a user (conversation menu), a profile (profile menu), or a danger alert (alert details) that violates these rules. Reports are confidential: the reported user is not told who made the report. The reported content and, where relevant, the surrounding messages are delivered to the moderators without end-to-end encryption, and text content may be automatically screened before a moderator reviews it. The handling of reports is described in the privacy policy.

Blocking. You can block another user from the menu of a conversation, a profile, or a group chat's participant list. After blocking, you no longer see each other among dog friends, on the map, or in events; the blocked user cannot message you or start a new conversation with you; and their messages in shared group chats are hidden from you. The blocked user is not notified. You can unblock at any time (Account → Blocked users), which restores visibility and the conversation history. Blocking does not remove either party from events you both participate in.

Moderation and sanctions. The moderators may remove content that violates the rules, issue a warning, restrict messaging for a fixed period, remove a user from an event, or close an account if these terms are violated. An event's organiser may also remove a participant from their own event. Repeated violations lead to account closure.

7. Danger alerts

Content. You can report dangers in the local area on the map: a loose dog, a dangerous place, poisoned bait, or another danger. An alert contains the danger's type, location, severity, description, and an optional photo. Other users can confirm the alert, add sightings to a loose dog alert, and follow it. Alerts are shown to others without the reporter's details.

Accuracy and liability. Report only dangers you have observed yourself or have reasonable grounds to believe are real. Danger alerts and sightings are users' own reports. Awuu does not verify them and is not responsible for their accuracy, timeliness, or completeness; the absence of an alert does not mean an area is safe. Awuu is not liable for damage resulting from reliance on alerts or their absence, unless otherwise required by mandatory law. In an emergency, contact the authorities.

Limits. You can create at most 3 danger alerts in 24 hours and add at most one sighting per hour to the same alert. An alert is visible on the map for 24 hours (poisoned bait for 7 days); a new sighting extends a loose dog alert's visibility to no more than 7 days from the alert's creation.

Photos and your own dog. A photo you attach to a danger alert or sighting is public and visible to all users. If you report your own dog as lost, your dog's breed and profile photo are attached to the alert; your profile name and photo are shown in the alert only if you give permission when creating it.

Misuse. False, misleading, or harassing danger alerts and sightings, and using alerts to defame another user or dog, are prohibited. Repeated reporting in the same area is automatically flagged for moderator review. Misuse may result in removal of the alerts, a warning, restriction of the right to report, or account closure in accordance with section 6.

8. User content and licence

You own the content you add to the service (e.g. photos, texts, events, and danger alerts). You grant Awuu a limited right to display and transmit your content within the service to the extent required to provide the service. The right ends when you delete the content or your account.

Publication on Awuu's social media accounts. If you give separate permission in an event's photo gallery, Awuu may publish the event photo you uploaded on Awuu's own social media accounts (e.g. Instagram) and mention the Instagram username stored in your profile alongside the photo. The permission is voluntary, and giving it is not a condition for uploading a photo to the gallery. You can withdraw the permission at any time by contacting info@awuu.app, after which the photo is removed from Awuu's accounts. Deleting your account does not automatically remove photos already published; request their removal from the same address.

9. Privacy

The processing of personal data is described in the privacy policy.

10. Changes to these terms

We may update these terms. Material changes will be announced in the service. Changes are marked with a new version number and date at the top of the page.

11. Governing law and disputes

These terms are governed by the laws of Finland. Any disputes will primarily be resolved through negotiation. If a dispute cannot be resolved, it will be settled in a competent district court operating in Finland.
